The Controlled Substances Act (Marijuana Prohibition) CLN-4U Unit One Essay Cailey Bazik CLN 4U – Unit One Essay Controlled Substances Act Marijuana Prohibition The Controlled substance act pertaining to Marijuana has been a long on going battle as to whether marijuana should be legal in Canada and taken out of this act. The law behind the drug has a long history and many failed attempts at decriminalization. There are both positive and negative effects to this law, but I believe the positive effects weigh out the negative and that because of this marijuana will be legal in the near future.The Marijuana laws in Canada today are unresolved, as superior courts have ruled all cannabis laws to be of â€Å"no force or effect†. Although the federal level of courts have made this ruling it has not caused any changes to other Canadian jurisdictions, the Criminal Code or the Controlled Substances Act. (â€Å"Legal History of Cannabis in Canada) The Controlled Drugs and Substanc es Act was passed in 1996 by the government under Prime Minister John Cretien. It is Canada’s federal drug control statue. This act outlines penalties for possession, trafficking and production of the substances established as illegal, including Marijuana. â€Å"Controlled Drugs and Substances Act) Canadian laws pertaining to drugs began in 1908 with the opium act, which was replaced by the opium and narcotic drug act in 1920. Marijuana however was not added to the confidential restricted list until 1923. (â€Å"Legal History of Cannabis in Canada†) Marijuana and the laws surrounding the issue only started to receive attention in the 1930’s and even then it was very minimal. It wasn’t until the 1960’s where problems arose with the law. At this time the maximum penalty for possession of small amounts of cannabis was 6 months n prison and a $1000 fine. A government injury was commissioned and public hearings were held to analyze the law over a perio d of three years. A report on the findings of this inquiry was published in 1972. The â€Å"La Dain Commission† suggested that penalties for can ibis possession be abolished, but to not legalize the substance. Of course this proposal was denied, along with other potential law reforms over the years. (â€Å"here to help†) In Recent Years the fight for the decriminalization of Marijuana has been more persistent.Research showed that Marijuana for medical use could help a number of ailments and disieses. Medical Marijuana in Canada was made legal in 2001 for things such as HIV, AIDS, multiple sclerosis, spinal cord disease and injury, anorexia severe pain, seizures and persistent muscle spasms. (â€Å"Legal History of Cannabis in Canada†) Along with the boost in medical use came a boost in personal use. According to a report from the United Nations Canada is the highest in marijuana use in the industrialized world and more than four times the global rate. â€Å"Can adian Pot Use Four Time Global Rate†) In May 2002 Chretien introduced a bill to decriminalize marijuana for personal use. This bill was denied mainly because of pressure from the U. S and a threat to slow down border crossing between the two countries. Paul Martin in 2004 tried to pass an almost identical bill, which was also rejected. (â€Å"Legal History of Cannabis in Canada†) It was in 2007 when Justice Minister Rob Nicholson and the conservative minority government introduced Bill C-26, which presented mandatory minimum sentences for drug offenders (â€Å"Controlled Drugs and Substances Act†).A recent poll released by Toronto’s Forum Research showed that majority of Canadians support relaxing marijuana laws. In fact it showed that 65 % of Canadians support either the decriminalization in small amounts or legalization and taxation of the substance. (Ballingall) Unfortunately with the new mandatory minimum sentences it seems our laws do not reflect soci eties views. (Wood, Antweiler) Although it seems Canadians and Americans are in favour of decriminalizing Marijuana it is important to understand the reason these laws are there in the first place.Marijuana is harmful to ones health and to youth. The president of the Canadian Police Association believes Canadians are trying to decriminalize marijuana prematurely. He says supporters of change are overlooking the risks. â€Å"We don’t have the tools and the training available to us now to ensure that people aren’t driving cars, for example, or operating machinery, while they’re impaired by Marijuana† he said. â€Å" There are all kinds of implications that I don’t think people are considering carefully enough†¦ Its still a harmful substance ultimately† (Ballingall)That being said there are many negative effects to having the prohibition of Marijuana in place. The Union of B. C municipalities passed a resolution summoning research be done looking into the legalization of marijuana. They came to the conclusion that the prohibition has been ineffective in deterring youth use, and production of the plant. (Wood, Antweiler) It seems that other measures need to be taken in order to ensure the youth of Canada don’t use drugs recreationally, and criminalizing marijuana has little effect. Researchers from the University of British Columbia and Simon Fraser’s university have estimated B.C’s marijuana market would be worth more than $500 million annually. Unfortunately most of the revenue goes to criminal organizations. (Wood, Antweiler) This number is based on one province alone, think of how much this number would go up if the whole country were involved in their research. The profiting of criminal organizations in turn causes more violence, guns and other illegal activity in the country. If Canada were to legalize and tax cannabis the government would then receive all the profits, this money could fund government programs such as health care, social assistance and education.It would also significantly decrease criminal activity, and save money in courts and jails. One of the main reasons in the past for the prohibition on marijuana was the negative response from the U. S, however there are now 12 states that have decriminalized Marijuana (Wood, Antweiler) meaning there is less pressure from our bordering Country. This and the obvious preference of legalization from Canadian citizens means it is only a matter of time before marijuana is officially decriminalized, taken out of the Controlled Drugs Act, the criminal code and consistent laws in all Canadian jurisdictions.This I believe will come first, and potentially government controlled sales and taxation shortly after. It would be insane for the government to not take seize the opportunity to bring in so much revenue for the country. It seems as though the prolonged struggle to legalize marijuana still needs time and The Controlle d Substances Act will remain as it is for a while longer. Although there are potentially many positive effects to decriminalization and controlled sales for taxation It is clear Canada still need the time to prepare to ensure it is done safety, effectively and not detrimental to youth.Canadians may be ready for a change and the government will eventually have to surrender, regardless of minor health issues cannabis causes. Disc Arthroplasty Essay

Degenerative disc disease have been a problem for many people as this disease brings about low back pain that seems to paralyze the working force,   the middle adulthood population (Smeltzer, 2004). Not only does it bring impaired quality of life to those who suffer from it, but Arvind Kulkarni adds large health care expenses to the list of problems brought about by this disease as seen in his article entitled Prosthetic Lumbar disc replacement for degenerative disc disease. Spinal fusion, which is the medical management for degenerative disc disease, has been criticized by several doctors in the practice due to its untoward effects in the patient’s overall recovery and lifetime improvement. Specialist in the field, Christoph Siepe, identified these unpleasant effects as accelerated adjacent system degeneration, pseudarthrosis, spinal canal stenosis, and donor site morbidity. Adjacent segment degeneration, as mentioned by Peter Ullrich in his article entitled Fusion versus Artificial Disc Arthroplasty for Lumbar Degenerative Disc Disease, stated that this is the major complication of spinal fusion and the reason why most surgeons want this procedure replaced. Adjacent segment degeneration or ASD happens when mechanical stress is transferred to the adjacent segment, also mentioned by Peter Ullrich. But research showed that this procedure can be modified to show more positive results. An anterior lumbar interbody fusion showed a low occurrence of revision surgery needed, which meant low frequency of adjacent segment degeneration, all pointed out in Mr. Ullrich’s paper.   However, to achieve this outcome, Mr. Ullrich declared that there should be an improvement in patient selection and in the procedure. The patients should be those patients having degenerative disc disease in their 5th lumbar to 1st sacral segment, because there is minimal motion at this level. By doing so, he states that fusing these segments do not change the patient’s mobility as much.   But not all are satisfied of this result. Doctors and specialists are continuously making efforts to totally changing the primary medical management for degenerative disc diseases. Studies have been conducted, and several replacement procedures were approved by the FDA. Peter Ullrich stated in his paper that the total disk replacement procedure was approved for medical use by the FDA in the year 2004 using the Charite artificial disc but for only one level of the spinal vertebrae, being the L4 – L5 or the L5 – S1. This is not the first time that a total or partial disc replacement was done. The history of this procedure was mentioned in an article in a website by Spine-Health that disc nucleus replacement was done first in 1955 by David Cleveland by injecting methyl-acrylic. Ever since then, there have two other FDA approved products aside from the Charite, the website Spine-Health states that the Prodisc was approved on August 2006 and the Kineflex lumbar on June 2005.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   A total disc replacement is being described by Jose Reyna in his article, Advances in Artificial Disc Technology, as being composed of two pieces of plates made of metal that has teeth to be able to attach itself to the end plates of the vertebral bones above and below it. This means that the particular intervertebral disc that is causing pain has to be removed and replaced by an artificial disc. Several artificial discs have been developed by various manufacturers in the country and they only differ in design and composition. The Charite, as mentioned earlier, is made up of a unique sliding core with two metal alloy end plates. The Prodisc being based on spherical articulations is made up of cobalt chromium molybdenum alloy as stated in the website Spine-Health. Inventors Qi-Bin Bao and Paul Higham developed a hydrogel prosthetic nucleus made up of PVA powder and a solvent mixed together, as seen on the article, Hydrogel intervertebral disc nucleus with diminished lateral bulging. The total disc replacement procedure has its advantages and disadvantages. Even after some models being approved by the FDA, it is still being assessed thoroughly by specialists in the field. Charles Rosen and Douglas Kiester report poor results and complications in the total disc replacement procedure. As it was mentioned in their study, this procedure causes fractures, severe pain, dislocations, extrusion of the implant, facet joint degeneration, and unexplained radiculopathy. They attribute these substandard results to the fact that the center of rotation of segmented motion is erroneous. Jose Reyna Jr. also mentions several disadvantages of the procedure in his study, stating that the anterior approach to the surgery can cause injury to the aorta and the common iliac vessels, can cause retrograde ejaculation in men by injuring the superior hypogastric plexus, hemorrhage can result from the retroperitoneal approach, and infection can occur. However, he also stated some advantages, as this procedure is said to maintain range of motion in majority of the patients as a long-term outcome. There are still a lot of studies to be conducted, and patients to be experimented on. A three year study conducted by Christoph Siepe et al., entitled Clinical Results of Total Lumbar Disc Replacement With ProDisc II: Three-Year Results for Different Indications, intended to assess total disc replacement outcome in patients who actually underwent the operation. Their results showed that not all degenerative disc diseases can be treated with this medical management. The best outcome was seen in patients exhibiting degenerative disc disease condition plus soft disc herniation or nucleus pulposus prolapse. Outcome was measured against the patient’s improvement from their preoperative levels. There were inferior results from the patients who had bisegmental damages, and a higher complication rate. Also it was mentioned that the younger patients, more specifically those aged below forty exhibited better outcome than those older than forty. Technology like this is still being developed, studied and modified as we speak. What is important is that there are people out there who care and who try to make a difference, whether it is by inventing, criticizing or being the experimental person wherein these new devices will be made a reality. From the African American population, 93 percent voted for President Obama as compared to 41 percent from the whites. The other 59 percent favored Mitt Romney, this goes to show that, people were voting mainly, for their own and that is why the votes of the black population was able to swing the vote towards their chosen one. It is clear from this that difference in racial backgrounds is still an issue that the Americans have to deal with. While it was thought that the election of President Barack Obama meant that, the black community had been fully accepted in America, statistics prove otherwise. A research carried out recently by a Stanford University professor, Jon Krosnick, showed that fifty one percent of the Americans still exhibited anti-black attitude explicitly. This is in comparison to forty-eight percent in 2008, the same research revealed that fifty six percent of the Am erican population harbor anti-black attitude implicitly as compared to forty-nine percent in 2008. This brings to light that the different races in America have not fully accepted each other and to make matters worse, it seems like the divide is getting worse. The Declaration of Independence states that all American citizens are equal but the reality on the ground shows that a good number of the population does not agree with that just yet (Lawson and Franklin, 295). However, a population of the Americans especially, the blacks seems to think that President Obama is not addressing the issue of race as people thought he would. He has been openly criticized by some African Americans due to what seems as his effort to stay away from the talk of racial divide and the issues that need to be addressed.
